Delaware Office of the Marijuana Commissioner seeking informal public comment on draft regulations

DOVER— Delaware’s Office of the Marijuana Commissioner has opened an informal public comment window on regulations for how the state will control the First State’s upcoming recreational marijuana market.

The public comment period began on Thursday and will conclude on March 29, during which, the office will release draft versions of the regulations on their website, allowing Delawareans to make their voices heard.

These materials can be found at omc.delaware.gov, where a link for individuals to provide their testimony and feedback is available.

According to the office, draft regulations are dependent on proposed legislative changes under consideration by the General Assembly, and standards may be adjusted based upon legislative action.

The available regulations are “a preview of the direction that the OMC is taking in the development of the formal regulations,” according to the office.

At the conclusion of the public comment period, the Office of the Marijuana Commissioner will launch the formal rulemaking process. Under this procedure, the office will file a notice of proposed regulations in the state registrar for publication in the Register of Regulations.

Once those regulations are published, a formal public comment period will commence. According to the office, May 1 through May 31 is the target window for this part of the process.

The draft regulations released Thursday include those applicable to the licensing of recreational marijuana businesses, the application process, issuance of licenses and the processes regarding the renewal and transfer of licenses.

The Office of the Marijuana Commissioner encourages Delawareans to review the preliminary draft regulations during this informal process, as well as the formal regulations once published in the Register of Regulations.
