Delaware Alcohol and Tobacco Enforcement officer charged with official misconduct

WILMINGTON — A Delaware Alcohol and Tobacco Enforcement officer has been charged with five felonies following an official misconduct investigation.

In a news release Tuesday, the Delaware Department of Justice said the counts resulted after Joseph Dominic, who is now suspended, allegedly traded DATE-controlled cigarette cartons to a third party for drugs and money.

Mr. Dominic, 33, faces five felony charges and one misdemeanor charge following a joint investigation by DATE and Delaware State Police. That inquiry began in October 2023, when supervising officers became suspicious of his handling of seized cartons of cigarettes.

Detectives discovered that Mr. Dominic had been issued 30 cartons of cigarettes from supervisors to provide them to other law enforcement agencies but instead sold the cartons to an unauthorized third party, the release said.

The profits from these sales were allegedly shared evenly between Mr. Dominic and the third party, whom authorities believe also provided illegal drugs to the officer, the Justice Department said.

Mr. Dominic is also accused of illegally submitting false information in police reports to conceal his conduct.

His felony charges are official misconduct, theft, theft by false pretense, second-degree conspiracy and first-degree tampering with public records, while his misdemeanor charge is illegal possession of a controlled substance.
