A ruling is expected on Delaware’s new vote-by-mail law. The Delaware Court of Chancery ruled last month that the law is unconstitutional, and the Department of Elections appealed. Eight states allow all elections to be conducted by mail, while 15 others permit by-mail voting in smaller jurisdictions within the state. What should Delaware do? (Editor’s note: The ruling overturning the vote-by-mail law was issued Oct. 7)

  • Well, your first statement is true. That does not, however, make the 2020 election invalid. Regardless of your personal opinion of the pandemic, it was ruled to be a valid reason within the framework of Delaware’s Constitution and election laws to be allowed as a reason for vote by mail. As for the assertion that Trump would have won Delaware, that’s a laughable absurdity. He lost by nearly 20% of the vote total, almost 100,000 votes. The idea that organized, widespread fraud cost him the election in states that were far closer (10,000-30,000 votes) is absurd enough that even judges appointed by Trump himself threw out challenges to the election because no one was able to produce actual evidence that widespread, outcome-altering fraud occurred. Delaware hasn’t gone for a Republican for president since 1988 and there are almost twice as many registered Democrats as Republicans. I don’t know what sources of information you rely on to form your opinions, but you may want to consider reevaluating them. I would never begrudge you for holding conservative views and voting accordingly, but this isn’t about ideology or political views. It’s about fact versus fantasy, and the idea that fraud or illegal voting cost Trump the election in Delaware or anywhere else is fantasy. — Andrew Martin

  • Your source is an article from an openly right-wing source, restating the opinion of one Republican senator, who did not review the arguments that were presented to the judges in question. Furthermore, he was talking specifically about challenges to how states ran elections in response to the pandemic and not specifically to allegations of fraud. Again, where you choose to get your information matters. Ultimately, the decisions on election law were left to state courts, which mostly decided that the pandemic was appropriate justification to expand the use of vote by mail. Other cases which were brought regarding vague allegations of fraud failed to meet minimum standards to show any likelihood that anyone had been wronged and had standing to bring suit. — Andrew Martin
