Speak Up: Auditor trial Question of the Day response

Posted

The first day of the trial of Delaware auditor Kathy McGuiness on criminal charges was halted as discussion focused on arguments by the defense due to the venue and lack of location in the indictment. The judge noted that “for centuries” the county where an alleged offense occurred is the venue where the case is prosecuted. The state then dropped the charges and will seek a reindictment on the same counts next week through a Kent County grand jury in Dover. Why should the trial location matter?

  • Dog and pony show. Taxpayers just being charged a big bunch for nothing. She has good lawyers and going to beat all these charges. Just a waste of time and state resources. She will probably be re-elected as well. — Vincent J. Deskiewicz Sr.
  • Is that a law or a custom? If it's a custom, then it shouldn't matter. If it's a law, then it needs to be amended to add a location of "entire state." If the criminal charges aren't in one particular county, but in the state, then the state could indict wherever it's most convenient for the state, or not be listed at all. — SalisburyWitch
