Letter to the Editor: Seaford moves to avoid legal issue for election

On March 7, I wrote to the candidates for Seaford City Council, attempting to alert them to an impending legal problem with the constitution of the Seaford Board of Elections (BOE).

The then-three-member BOE was in violation of Seaford’s charter, which requires five members on the board.

On March 7, I also tossed out a possible solution to the problem: mayor and City Council appointing two additional members to the BOE for the April 17 election.

Now, on April 13, less than five days from the election, Seaford’s mayor and City Council were set consider, per the meeting agenda under new business, item number 12 which states, “Present for approval appointments for the Board of Elections for the 2021 Municipal Election.”

According to Seaford Councilman Dan Henderson, two additional BOE members will be appointed, to make a total of five, as currently required by Seaford’s charter. This action will avoid a legal crisis during the April 17 election.

After months of work to this end, I can only say, “Whew!”

While this “fix” comes at the last minute, City Council candidates and the citizens of Seaford deserve to have a fair election consistent with the election laws in Chapter 75 of the Delaware Code and Seaford’s charter.
