CLAYTON — A switch to high beams caught an officer’s attention and brought the eventual arrest of a 33-year-old Clayton man on an alleged sixth drunken driving offense charge early Saturday morning, police said in court documents.

According to a Clayton Police Department officer in an affidavit of probable cause, a vehicle stop was made after an oncoming vehicle’s change to high beam headlights exposed him to “instantaneous illumination” while traveling eastbound on Duck Creek Parkway at approximately 12:45 a.m. The officer’s vehicle were on low beam at the time, he said.

The officer said in court papers that he did a did a u-turn onto westbound Duck Creek Parkway, activated emergency lights and stopped a Jeep Cherokee that turned onto Dump Road and then Council Drive.

According to police in documents, the driver allegedly “had glassy, watery and bloodshot eyes. His speech was mumbled, slurred and he talked in a rambling matter.”

After presenting a valid Delaware identification card, police said in papers, the driver allegedly “admitted he had a couple of beers and only drove because his female passenger was intoxicated and unable to drive.”

According to police, the driver refused to perform any field sobriety tests.

Police said in papers that Jason C. Underwood, of the first block of Council Drive, had DUI convictions in 2002, 2009, 2011 and 2014, and a reckless driving alcohol related conviction in 2006.

Authorities said in documents that a blood kit was used to draw a blood sample for alcohol testing at Smyrna Emergency Center. The blood alcohol content level is pending based on analysis, police said.

Police said Mr. Underwood’s drivers license was revoked for 60 months on March 3, 2014.

Mr. Underwood was charged with felony sixth offense driving under the influence of alcohol, misdemeanor driving while suspended or revoked, and a failed to use low/regular beams within 500 feet of an oncoming vehicle, according to papers.

After arraignment through Justice of the Peace Court 7 in Dover, Mr. Underwood was held by the Delaware Department of Correction on a $5,101 secured bond that was not immediately posted. A preliminary hearing was scheduled for Friday morning in the Kent County Court of Common Pleas.
