LEWES — A 38-year-old Lewes man was arrested after Grotto Pizza was burglarized Saturday, Delaware State Police said.

Spokeswoman Sgt. India Sturgis said that, at approximately 9:36 a.m., troopers responded to the restaurant at 17467 Shady Road for a reported trespassing. When they arrived, the business was in the process of opening for the day.

Troopers saw Jacob Capozio sitting on the ground in a fenced area behind the building, she said. He appeared to be sleeping, and the officers announced their presence in an attempt to wake him.

He awoke, and police discovered he was wearing a Grotto Pizza polo shirt. An employee identified it as a store uniform and confirmed that it had been removed from the restaurant’s inventory, Sgt. Sturgis said.

An employee also verified that Mr. Capozio is not employed at Grotto. Video surveillance revealed that he had entered the building and removed merchandise valued at less than $1,500, police said. He was taken into custody without further incident.

Mr. Capozio was charged with third-degree burglary, theft under $1,500 and third-degree criminal trespass. He was arraigned by Justice of the Peace Court 3 and committed to Sussex Correctional Institution, Georgetown, on a $4,200 secured bond.
