Elizabeth Day, wife of Salisbury Mayor Jake Day and a teacher at James M. Bennett High School, was charged Friday in connection with an attempted drug transaction with a student.

Day, 30, was charged with attempted possession of a controlled dangerous substance and contributing to certain conditions of a child, after turning herself in at the Wicomico County Sheriff’s Department, according to her attorney John Phoebus.

Each of the charges is regarded as a misdemeanor.

In May, Elizabeth Day spoke about her own struggles with pain killers in a Wicomico Goes Purple event at Prince Street Elementary School that stressed making good decisions and avoiding opioid and substance abuse.

“She was released on her own recognizance based upon the relatively minor nature of these charges and the fact that she has never been in trouble her entire life,” Phoebus said is a statement emailed to members of the news media.

“Mrs. Day is committed to her family, her children, and the Salisbury community. While she is cooperating with the investigation, she is presumed innocent of these charges. We intend to litigate this matter only in the courts and we will have no further statements concerning these charges until her trial in February.”

According to state District Court records, Day -- who works as a Physical Education teacher at Bennett -- asked a student to get her Adderall, a prescription drug generally used to treat attention deficit hyperactivity disorder and narcolepsy, but it is often sold illegally as a stimulant.

The student told Day they could not get the drug for her, the court records said, but later contacted her at the direction of the Wicomico County Sheriff’s Office and agreed to sell her two pills.

The transaction on Dec. 10 in the school locker room was recorded by investigators, according to the court filing. 

Day was placed on administrative leave pending the outcome of the investigation, according to Wicomico schools Superintendent Dr. Donna Hanlin.

“Wicomico County Public Schools is working in full cooperation with the legal system in this matter,” Hanlin said in a statement. “Our first priority is always the safety and well-being of our students and staff. As this is an ongoing investigation, Wicomico County Public Schools cannot provide any additional information."

Her husband was re-elected Salisbury’s Mayor last month. The Days are the parents of two young daughters.

Mayor Day released a statement statement Friday afternoon.

“This is a very difficult time for our family. My wife, Elizabeth, is a great mother to our two children and committed to this community," he said.

"Liz has dealt with challenges that millions of Americans have, and though she must now live through those challenges in the public eye, I know the health and well-being of our family is the single-most important thing in her life.  In this moment, my role is to love and support my wife and our children, and that’s what I intend to do."
