DOVER — A 24-year-old Magnolia man was allegedly found with drugs and deadly weapons during a DUI of alcohol arrest early Saturday morning, according to police in court records.

While in the Dover Police cellblock after being taken into custody, authorities claimed, Eric M. Voshell, of the 300 block of Plain Dealing Road allegedly yelled “You guys aren’t worried about the people out here selling heroin, but [you’re] going to arrest the guy selling weed.”

The alleged incident unfolded at approximately 1:35 a.m. at the Wawa at 290 S. DuPont Highway after a reported hit and run crash involving a pickup truck and a fence a short distance away, police said in a probable cause affidavit.

Police first arrived at TGI Fridays at 222 S. DuPont Highway to investigate the hit and run, according to the affidavit, and were told that a vehicle also ran over another curb when leaving and heading southbound on S. DuPont Highway in a tan Chevrolet Silverado.

An officer said in documents that a vehicle matching the description was seen at the Wawa parked next to a gas pump and an investigation ensued. Police said Mr. Voshell and another unidentified man allegedly walked from the vehicle.

Mr. Voshell was contacted inside the Wawa, police said, and allegedly “had a strong odor of alcoholic beverages on his breath, and was stumbling.

“His words were slurred as he spoke.”

A pair of brass knuckles was found on Mr. Voshell, according to police in papers, and he allegedly failed pre-exit DUI tests before taking a Portable Breath Test that registered .276.

A vehicle search netted 18.3 grams of marijuana packaged in two bags, authorities said, two bowls, a bong and digital scale, along with a book about marijuana.

“All the items had marijuana residue on them,” police said in documents.

A 3.25 inch knife was allegedly found on the driver’s seat authorities said. According to police, Mr. Voshell was banned from possessing a deadly weapon due to a drug dealing conviction on May 6, 2013.

“While being detained in the back of a patrol car, [Mr. Voshell] kicked the windows and door of the car,” an officer wrote in the affidavit.

“He was also yelling profanity which caused a risk of public alarm.”

Charges included possession of a deadly weapon during the commission of a felony, drug dealing with an aggravating factor, possession of a deadly weapon by person prohibited, possession of marijuana, disorderly conduct, DUI, and carrying a concealed deadly instrument.
