DOVER — A confidential informant connected to a drug and weapons case in Dover last summer should remain anonymous, a judge ruled in Kent County Superior Court on Tuesday.

On Feb. 1, the defense for Isaac W. Montague made a motion to identify an undisclosed person who “cooperated with the Dover Police Department by participating in several controlled buys with Montague” at a residence in the 400 block of New Castle Avenue in the Capital Green neighborhood, according to court documents.

Resident Judge William L. Witham Jr. denied the motion, noting that the charges against the defendant resulted from a search warrant executed by police on July 16, 2015, when the confidential informant was not present. The informant also did not earlier participate in any illegal act that Mr. Montague was charged for, the Court ruled.

While Mr. Montague claimed the informant could assist in his defense, Judge Witham found that “At no point does Montague offer an argument that would rise above mere speculation.

“In fact, it appeared to the Court that the informant could be harmful to the defendant’s case.”

According to Judge Witham, it was determined that the confidential informant “had no information that would materially aid the defense ...” in a proceeding held in private chambers on Feb. 1.

Mr. Montague was charged with five counts of possession of a firearm by person prohibited, and a count each of drug dealing, tampering with physical evidence, endangering the welfare of a child and possession of drug paraphernalia, documents said.
