DOVER — A jury could not decide unanimously on a second-degree rape charge against a 37-year-old Dover man, and a mistrial was declared on Friday, the Delaware Department of Justice said.
Jenon N. McPhatter was arrested on Dec. 6, 2014, regarding an alleged incident involving a 29-year-old woman at an undisclosed residence on Chelsea Way, the Dover Police Department said earlier.
He was indicted on Feb. 2, 2015.
The hung jury ended a trial that began on Tuesday before Judge Jeffrey Clark in Kent County Superior Court.
Seven previous trial dates were postponed from April 7, 2015, to Jan. 19, 2016.
Deputy Attorney General Kathleen Dickerson prosecuted the case for the state and attorney Alex Funk represented Mr. McPhatter.
