DOVER — An eight-count indictment was returned this week against a Bear man involved in a July 31 vehicle crash that left another man in critical condition, according to court papers.

In Superior Court, a Kent County Grand Jury charged David W. Talley, 20 at the time of the alleged incident north of Greenwood, with felony first-degree vehicular assault and misdemeanor possession of marijuana, possession of drug paraphernalia, and driving a vehicle while under the influence of alcohol and/or drugs.

Traffic violation charges included unreasonable speed, improper lane change, driver of motor vehicle shall properly secure all passengers with a seat belt, and driver not wearing a seat belt.

Delaware State Police earlier said that a 44-year-old Newark man was in critical condition after being taken to Christiana Medical Center by its Aviation (Trooper 2) unit. Mr. Talley was taken by EMS to Milford Memorial Hospital, where he was treated and released for non-life-threatening injuries, police said.

According to authorities at the time of the incident, investigation found that a 2004 Ford F250 pickup truck overturned several times on U.S. 13 approaching Marsh Branch Road at approximately 4:40 p.m. The driver and passenger were ejected onto the ground, authorities said.

Police alleged Mr. Talley lost control of the truck while driving northbound at an apparent high rate of speed, and the vehicle drove off the east side of the highway, struck a “One Way” sign and mailbox. The vehicle then re-entered the northbound lanes, crossed over into a center median before striking an embankment, police said.

Police said northbound and southbound traffic was affected for approximately two hours as the incident was investigated by the state police Collision Reconstruction Unit and cleared.
