Trial set for alleged trigger man in cold case murder

DOVER — Results of a seven-year investigation will be on display during a first-degree murder trial scheduled to open early next month.

Larry Pierce is accused of shooting a 23-year-old Magnolia man to death on April 18, 2009, though he wasn’t indicted until July 2016.

Investigators said there wasn’t enough evidence to file charges immediately after the incident, but the probe continued until a suspect was identified.

Jury selection is scheduled for Feb. 5. Deputy Attorneys General Greg Babowal and Lisa Whitlock will prosecute the case, with Lloyd Schmid and Rick Matoni representing Mr. Pierce.

Superior Court Judge Jeffrey Clark will officiate the trial.

Dover Police said Josue Barclay, 23, died from a gunshot wound to the back of the head and was found lying in the first block of South Governors Avenue.

According to authorities, a shell casing from the shooting matched a handgun recovered during a traffic stop on April 26, 2009.

Mr. Pierce and two other men fled from the vehicle but were later apprehended, police said.

Mr. Pierce was 33 years old when indicted two years ago. He was in federal custody on unrelated charges at the time and was extradited to Dover.

The Delaware Department of Justice said Mr. Pierce was serving a combined 210 months for felony bank robbery convictions in Nevada and Delaware, beginning on Nov. 20, 2014.

He was held in United States Penitentiary Lee in Pennington Gap, Virginia, officials said.
