Clayton man faces felony drunken driving charge

CLAYTON — A 29-year-old Clayton man was charged with felony drunken driving last Sunday after a 1:45 a.m. traffic stop, an arrest affidavit said.

A Clayton Police officer alleged that a vehicle driven by Gary A. Everett Jr. - who later pled not guilty - was initially seen crossing the center line several times by approximately two to three feet on Wheatleys Pond Road before swaying back into the proper lane. When the vehicle allegedly made a wide left turn onto School Lane without signaling, a patrolman made a stop in a Southern States parking lot.

A police officer noticed the driver’s “eyes were very watery and bloodshot,” according to court documents. The driver produced his license, authorities said, but said the vehicle was a rental and could not provide a registration or proof of insurance.

According to the affidavit, Mr. Everett “stated that he did have a few beers at his friends house and was on his way home.”

The officer “also noticed that the operator’s speech was slurred.” Field sobriety tests followed and Mr. Everett was taken into custody after refusing to take a Portable Breath Test, police said. He refused to take an intoxilyzer test as well when taken to the Smyrna Police Department, police claimed.

Police said Mr. Everett was previously convicted of DUI in May 2010 and reckless driving alcohol/drug related in February 2015.

Charges included third offense driving a vehicle under the influence of alcohol, failure to have insurance identification in possession, failure to have registration card in possession, failure to signal and failure to drive in proper lane and direction.

Mr. Everett entered not guilty pleas at Justice of the Peace Court 7. He was then released on a $2,560 unsecured bail. A court hearing was scheduled for Friday.
