Magnolia couple charged in infant's death

MAGNOLIA — Angel Toran, 22, and her fiance, Ny’Jier Murphy, 24, both of Magnolia, were arrested Thursday for murder by abuse or neglect and related charges in connection to the death of their infant, authorities said.

According to Delaware State Police spokeswoman Master Cpl. Heather Pepper, troopers and staff from the Division of Family Services went to the couple’s home in the 400 block of Lambert Drive on Oct. 10, 2021, to check on the welfare of an infant. DFS had received information that a child had possibly died at the home and that the death was unreported to authorities, DSP said.

When troopers initially arrived at the residence, Ms. Toran and Mr. Murphy were not home but arrived a short time later. When troopers contacted Mr. Murphy, a concealed Glock 9 mm handgun was observed in a holster on his hip, Cpl. Pepper said. A computer inquiry determined that he didn’t possess a permit for carrying a concealed deadly weapon in Delaware, authorities said.

DSP’s Homicide and Major Crimes units subsequently conducted an investigation into the infant's death and determined that Ms. Toran gave birth to a baby girl at home in April 2021 and that the child’s birth was never reported to the state, Cpl. Pepper said. In mid-September, the baby died at the age of 5 months, she added.

The baby was buried on the property, police said. The infant’s body was exhumed from the property Oct. 11, 2021, and turned over to the Division of Forensic Science for an autopsy, authorities said.

The investigation found that the infant was severely malnourished and succumbed to medical issues associated with that condition, DSP said. As a result, the Attorney General’s Office approved charges for the couple, and arrest warrants were obtained for their arrests.

On Thursday, Ms. Toran and Mr. Murphy went to DSP Troop 3 in Camden. As Mr. Murphy was notified of his arrest warrant by troopers, he resisted arrest and was taken into custody after a brief struggle, authorities said. Ms. Toran was arrested without incident.

Police are continuing to investigate, and additional charges, including resisting arrest resulting from Mr. Murphy’s actions at Troop 3, are forthcoming.

Mr. Murphy and Ms. Toran were each charged with first-degree murder by abuse or neglect recklessly causing the death of a child and first-degree conspiracy. Mr. Murphy was additionally charged with carrying a concealed deadly weapon.

Ms. Toran was arraigned in Justice of the Peace Court 2 and committed to the custody of the Department of Correction on a $260,000 cash bail.

Mr. Murphy was arraigned in JP Court 2 and was committed to Sussex Correctional Institution, Georgetown, on a $270,000 cash bail.
