WILMINGTON — Rebecca Walker was found not guilty Thursday of three misdemeanor charges regarding her time spent as deputy director of the state Division of Forensic Science.
The hearing took less than five minutes. Ms. Walker, 54, shed tears when the verdict was announced.
In April 2021, Ms. Walker was indicted on single counts of falsifying business records, offering a false statement for filing and official misconduct. The indictment pointed to alleged activity between May 8, 2015, and Feb. 3, 2020.
When announcing the charges, the Attorney General’s Office maintained that she faked records to indicate that employees had passed drug tests that were never taken.
Superior Court Judge Francis Jones issued the verdict in the bench trial. Ultimately, the judge found the state failed to prove beyond reasonable doubt that Ms. Walker had intended to deceive or attempted to obtain personal benefit.
Ms. Walker and her attorney, John Malik, declined comment Thursday. The prosecutor also had no statement.
In an email, Mat Marshall, a spokesman for the Department of Justice, said, "No comment here except to say that we have a responsibility to seek accountability under the law and are proud of the team that brought this case to trial."
The trial opened on April 12.
Ms. Walker is currently the director of nursing for the state Division of Public Health, where she started on March 1, 2020.
Ms. Walker was formerly a member of the Delaware House of Representatives from 2011 to 2015.
