The Delaware Senate is slated to reconvene Tuesday at 4 p.m. to consider legislation that seeks input from the Delaware Supreme Court on how legislators could determine a process to remove State Auditor Kathy McGuiness from office.
House Concurrent Resolution 42, sponsored by Rep. Sean Lynn, D-Dover, was approved by the House on Monday with 25 votes in favor, eight against, six not voting and two absent.
The resolution is a modification of Senate Concurrent Resolution 63, which passed the Senate also on Monday. SCR 63 was sponsored by Senate President Pro Tempore David Sokola, D-Newark, and was approved in a 14-7 vote, which was split down party lines.
The House’s resolution also tasks the Judiciary Committees of the House and Senate to meet jointly on or before Dec. 17 to determine the process for removing Ms. McGuiness from office if it is determined that reasonable cause for her removal exists.
Both resolutions would take effect upon passage in the final chamber.
Ms. McGuiness, a Democrat, was indicted Oct. 11 on five charges, including two felonies, for alleged misconduct in office. She has pleaded not guilty to all of them.
